生产安全事故调查基本规范

1范围

本文件规定了生产安全事故调查的原则、方法、基本规范和主要技术要求。

本文件适用于生产安全事故的调查和处理。

3术语和定义

下列术语和定义适用于本文件。

3.1

现场调查investigationofthescene

事故调查人员依法对事故现场的场所、痕迹、物品、人体等进行搜寻、询问、检查、测量、照相固

定、提取的活动。

3.2

现场图pictureofthescene

客观记录事故现场环境、事故形态、人员(包括伤亡人员)、痕迹、物体等位置及其相互关系的图。

现场图包括现场记录图、现场实景记录图(包括现场激光三维扫描图、现场实景俯瞰记录图)、现场比

例图、现场断面图、现场立面图和现场分析图。

3.3

现场记录图drawingofthescene

调查人员在生产安全事故现场手工或使用计算机辅助系统绘制的图形、符号、测量数据、文字记录

的现场调查图。

3.4

现场照相photographingthescene

运用摄影技术记录事故现场痕迹、物证及周边环境情况的事故调查活动。

3.5

电子物证electronicevidence

以存储于介质载体中的电磁记录或光电记录信息数据及其附属物。

3.6

证据固定evidencefixing

采用照相、录像、绘图、笔录和测量等方法对调查所发现的痕迹、物品、物证、书证、电子物证等

进行固定。

3.7

证据提取evidencecollecting

对已发现的能够证明事故真实性的证据,在充分固定后进行收集的活动,包括物证、书证、电子物

证等。

3.8

调查实验experiment

事故调查人员依法组织实施的模拟再现、复制、演示与事故案件有关的某些事实、现象、情节等的

活动。

4一般要求

4.1事故调查的任务与要求

4.1.1事故调查主要有下列任务:

a)查明施工单位基本情况、事故原因、经过及后果;

b)收集事故证据,包括现场痕迹、物证、书证、伤亡情况、当事人陈述、证人证言、现场调查

笔录等;

c)分析事故性质,划分事故责任;

d)提出处理意见和事故预防对策建议。

4.1.2事故调查应按照以下要求开展:

a)依法受案,严格审批;

b)依法、客观、公正开展调查;

c)分工合作,互相配合,及时调查,全面收集证据;

d)及时寻找目击者、证人,协助公安机关控制嫌疑当事人、直接责任人、管理责任人等;

e)编写、制作调查报告。

4.2事故调查人员要求

4.2.1事故调查由事故调查人员依法开展调查工作。事故调查人员应当符合具备相关知识与技能,并

符合国家有关规定要求。

4.2.2事故调查人员依法开展以下调查工作:

a)对事故现场进行调查,查验、测量、照相、记录事故现场、痕迹、物品;绘制现场图,制作现

场调查笔录;照相固定证据,收集、提取物证、书证等;

b)询问事故当事人、安全责任人、安全管理人、现场目击证人、其他证人等;

c)查阅、调取、复制相关安全管理文件、档案、资料、日志、数据信息、安全管理记录等;

d)走访、询问相关部门和企事业单位负责人、参与救援的单位和人员、伤者及近亲属等;

e)根据调查需要,聘请或者委托有关专业技术人员或者机构参与调查;

f)组织实施调查实验等。

4.3事故调查装备

4.3.1事故调查装备,包括但不限于交通工具、通讯工具、照明工具、现场勘查工具、物证提取保存

工具、照相录像工具、绘图工具、无人驾驶航空器、人身安全防护装备等。

4.3.2事故调查中宜使用有关事故调查工具,保证事故调查工作顺利进行,确保事故调查取证及时、

完整、准确。用于事故调查的装备,可参见GA/T945、GA/T1381、GA/T1382、GA/T591等相关行业标

准要求。

5现场调查

5.1现场调查的原则与要求

5.1.1现场调查应当遵循依法、公正、安全、及时、客观、科学、全面、系统、规范的原则。

5.1.2开展现场调查的事故案件应按照规定进行受案登记。受案登记表格式见附录A。

5.1.3现场调查应根据事故类型、特点、危害性、影响范围等,及时制定现场调查策略、计划,按照

“先静后动、由外及内、先固定后提取、先低处后高处、先重点后一般、先易灭失后稳定”的顺序,全

面、仔细开展现场调查。

5.1.4现场调查应通过照相、录像、测量、绘图、调查笔录、现场访问、询问等方式,对生产安全事

故现场进行调查,提取物证、书证,依法全
